1. Who can request restitution?

   If you are a victim with out-of-pocket expenses resulting from the crime, you may request restitution. Organizations such as churches, schools, businesses, and government agencies may also request restitution.

2. What will restitution cover?

   Eligible expenses may include, but are not limited to, medical and dental bills, counseling costs, lost wages, property losses, and repairing damaged property.

   If the entire amount of expenses is unknown at the time of sentencing or juvenile disposition, your restitution amount may be determined later, though you should still request restitution. You may also request restitution for anticipated expenses such as ongoing medical or counseling expenses.

3. What expenses are not covered?

   Any costs not related to the crime will not be included in restitution.

   For example, a criminal court cannot order restitution for physical pain, suffering, or emotional trauma. You may hire an attorney to pursue a personal injury claim if you wish to seek financial compensation for such losses. However, when seeking this option, keep in mind the offender’s financial resources and their ability to pay. 

4. How do I request restitution?

   To file for restitution, you must first fill out an Affidavit of Restitution form. This should be supported with copies of documents detailing your expenses including medical and/or dental bills, insurance co-payment receipts, estimates for stolen or replacement/repairing items, counseling bill, transportation expenses, proof of lost wages, and any other expenses.
