Retail Food Establishment
Overview
A retail food establishment is that portion of any location or business dedicated to the retail serving, preparation, processing, sale of grocery, bakery, or animal products.

Retail or Wholesale
Retail means the sale of food products directly to the consumer, usually in small quantities and not usually intended for resale.
A wholesale establishment is where the total gross sales from the wholesale processing, manufacturing, and/or distributing operations exceed 50% of the establishment's gross sales. Wholesale food establishments in the City of Saint Paul are licensed by the Minnesota Department of Agriculture.
Retail Food Establishment Licenses
- Retail Food Establishment - Bakery License
A retail food establishment-bakery is the main portion of any location or business that is dedicated to the retail manufacturing, processing, preparation, storage, handling or selling of bakery products. Bakery Products include food items such as, but not limited to, bread, rolls, buns, cakes, cookies, crackers, doughnuts, pies, pastries, pretzels, and potato chips.
- Retail Food Establishment - Butcher License
A retail food establishment-butcher is the main portion of any location or business that is dedicated to the retail manufacturing, processing, preparation, storage, handling or selling of animal products. Animal Products means the portions of animals used as food, such as, but not limited to, the dressed flesh of cattle, swine, sheep, goats, wild game, poultry, fish, shellfish, shellstock, and other edible animals or similar types of foods that are offered for human consumption.
- Retail Food Establishment - Farmers' Market License
A retail food establishment - farmers' market is an establishment operated in accordance with and subject to the regulations and provisions of Chapters 11 (City Market) and 331A (Food Protection Standards) of the Saint Paul Legislative Code. Review Farmer's Market Health Rules and Farmer's Market Health Issues before applying for a license.
Exclusions: Minnesota Consolidated Food License Law, Section 28A.15, Subd. 2 states that persons selling products of the farm or garden occupied and cultivated by them do not require a City of Saint Paul license; but they are required to comply with all applicable food regulations.
- Retail Food Establishment - Food Salvage License
A retail food establishment-salvage is the main portion of any location or business that is dedicated to the retail recovery or processing of damaged or deteriorated food and/or pet products for resale.
- Retail Food Establishment - Grocery License
A retail food establishment-grocery is the main portion of any location or business that is dedicated to the retail manufacturing, processing, preparation, storage, handling or selling of grocery products. Grocery Products are food items including, but not limited to, packaged or bulk foods such as candy, snacks or chips, refrigerated and frozen foods, dairy products, canned foods, dry goods(i.e. tea, coffee,spices, sugar, flour, etc.), fruits and vegetables, bakery products, and animal products.
- Retail Food Establishment - Nonprofit License
A retail food establishment - nonprofit is an establishment operated by a nonprofit organization, such as a food shelf, that provides food without charge, for humanitarian purposes.
- Retail Food Establishment - Restricted Food Service
This is an additional license allowing the serving of foods that are restricted to coffee, popcorn, bakery products, or nonalcoholic beverages in a licensed Retail Food Establishment. This license is for establishments that have a retail food establishment license but do not have one or more Retail Rood Establishment - Secondary Facility License
- Retail Food Establishment - Secondary Facility License
A retail food establishment - secondary facility is a retail service or operation which is separate, distinct or unique from the central or main food area, within a license retail food establishment, used for the sale, serving, preparation, processing or salvaging of foods. Examples of a secondary facility include a bakery, butcher or salvage operation within a grocery type of establishment or a grocery operation with a butcher or bakery type of establishment. This license allows the serving of foods that shall be restricted to coffee, popcorn, bakery products or nonalcoholic beverages. Each secondary facility requires a separate license.
- Retail Food Establishment - Temporary License
A retail food establishment - temporary is a temporary establishment where food sales are restricted to prepackaged non-potentially hazardous foods or canned or bottled nonalcoholic beverages; operating no more than fourteen (14) days annually at any one location. Must submit a Special Event Food Sales Application.
General Requirements
Refer to Retail Food Establishment - Secondary Facility for any additional licenses required if the location or business includes secondary areas dedicated to the sale, serving, preparation, processing, or salvaging of food. Example: A grocery store with an area dedicated to bakery products or a butcher shop with an area dedicated to grocery products.
Note: A business licensed as a retail food establishment may require other City of Saint Paul licenses such as cigarette/tobacco, restaurant, etc.
Environmental Plan Review
Any construction, remodeling, or alterations to a food establishment requires that plans and specifications be submitted to the Environmental Health Section for review and approval.
Change of Ownership Review
When a food establishment changes ownership, a review of the premises is required to determine compliance with the requirements of Chapter 331A.

Permits & Other Approvals
Contact the Zoning Section (Ph: (651) 266-9008), Building Inspection (Ph: (651) 266-9007), and Fire Certificate of Occupancy (Ph: (651) 228-6230) for any other city zoning, fire, plumbing, mechanical, electrical, or construction permit requirements or approvals.

Inspections
This license requires inspection approvals from the Saint Paul Fire Department (Ph: (651) 266-8989), Environmental Health (Ph: (651) 266-8989), Licensing (Ph: (651) 266-8989), and Zoning (Ph: (651) 266-9008).
Fees
The license fee for a retail food establishment is based on the square footage of the establishment and is determined by the total area used for the display, preparation, processing, storage and sale of foods such as grocery, bakery and butcher products. Support areas such as offices, bathrooms, hallways, and similar spaces shall also be included. Basements are not to be included as part of the retail food establishments except for areas used for food preparation or processing.
